These Terms of Use are entered into by and between you and Elite Golf Society, LLC, an Arizona limited liability company (“EGS,” “Company,” “we,” or “us”). These terms and conditions, together with any documents expressly incorporated by reference (collectively, these “Terms of Use”), govern your access to and use of elitegolfsociety.com, including any content, functionality, and services offered on or through the website, including the member login portal (the “Website”), whether as a guest or a registered member.

By accessing or using the Website, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, found at elitegolfsociety.com/privacy-policy, which is incorporated herein by reference. If you do not agree to these Terms of Use or the Privacy Policy, you must not access or use the Website.

Age and Eligibility Requirement. This Website is offered and available only to users who are 18 years of age or older and reside in the United States. By using this Website, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract with EGS. Member Accounts, Login Portal, and Account Security

We reserve the right to withdraw or amend the Website, including the member login portal, in our sole discretion without notice. We will not be liable if all or any part of the Website is unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to access the Website and for ensuring that anyone who accesses the Website through your internet connection or device is aware of, and complies with, these Terms of Use.

To access the member portal, you will be asked to register and provide certain account information. • To introduce viruses, Trojan horses, worms, or other material that is malicious or technologically harmful, or to attack the Website via a denial-of-service attack.

Contact Forms and AI Chat/Q&A Features

The Website may include a “Contact Us” form and/or an AI-powered chat or question-and-answer feature (the “AI Assistant”). Responses provided by the AI Assistant are generated automatically and are provided for general informational purposes only. They do not constitute legal, medical, financial, or professional advice, and EGS does not guarantee the accuracy or completeness of any AI-generated response. EGS staff may review and follow up on submissions made through the Contact Us form or the AI Assistant. All membership fees and dues are governed by the EGS Membership Terms & Conditions, which are incorporated into these Terms of Use by reference, and which provide that all fees and dues are non-refundable. EGS does not control and is not responsible for the security practices of third-party payment processors, although we require our payment processor to use industry-standard safeguards.

The information presented on or through the Website is made available solely for general informational purposes. We do not warrant the accuracy, completeness, or usefulness of this information, and any reliance you place on it is strictly at your own risk.

Geographic Restrictions

Governing Law and Jurisdiction

These Terms of Use and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Arizona, without giving effect to any choice or conflict of law provision. Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the state or federal courts located in Maricopa County, Arizona. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Waiver and Severability

No waiver by EGS of any term or condition in these Terms of Use shall be deemed a further or continuing waiver of such term or any other term. If any provision of these Terms of Use is held to be invalid, illegal, or unenforceable, such provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions continue in full force and effect.

Entire Agreement

These Terms of Use, our Privacy Policy, and, for members, the EGS Membership Terms & Conditions constitute the entire agreement between you and EGS regarding the Website and supersede all prior understandings regarding the Website.
